European Parliament · 5 October 2021
Artificial intelligence in criminal law and its use by the police and judicial authorities in criminal matters
Adopted
377 in favour · 248 against · 62 abstained. 687 members voted.
What it asks for, in the Parliament's words
- Calls on the Commission to assess the AI technology available on the market and the level of use by police and judicial authorities on a country-by-country basis
- Emphasises the importance of AI being used with due respect for the principles of the rule of law and the independence of the judiciary in the decision-making process
- Underlines that the sovereign discretion of judges and case-by-case decision-making have to be upheld in order to avoid the standardisation of decisions based on purely statistical calculations
